What should I do if I get a DUI?
First if your blood alcohol was over .080 or you refused a test and they took your license and gave you an Affidavit of Revocation, you will need to request a hearing with Motor Vehicles within the first 7 days. There are two choices of requesting the attendance of the Officer or not at the hearing. Call me and I can clear up the details for your case. Next you need to enter a not guilty plea to set up a possible plea bargain or to set up a trial date. I will do that for you and then you do not have to go to court on the date of the ticket. We will get discovery ( that is a copy of all the documents that the DA has against you) and see what the best approach there is to attack this charge. That is when I meet with the DA and have what is called a pre-trial. If all goes well we can set up a disposition hearing. That is when we go before the Judge to resolve the case. Most cases are settled like this in a plea bargain. If we can not resolve it we will have to go to trial.
